Kaleidescape Gets Another Reprieve: DVD Servers Survive Another Year
In affirming the stay of an injunction against Kaleidescape DVD movie servers, court lets the manufacturer continue to make products until case with DVD CCA is settled.
The DVD CCA vs. Kaleidescape saga continues, with a judge recently extending the stay of an injunction that would have required the manufacturer to cease development of its DVD movie servers until all appeals are exhausted.
The DVD CCA, which licenses the Content Scramble System (CSS) copy-protection scheme for DVD players, enjoined Kaleidescape from selling its flagship DVD movie servers because they do not require a physical disc to be present at playback – a requirement of the CSS licensing agreement, according to the DVD CCA and the courts.
Shortly after the injunction was ordered, the court granted a temporary stay, allowing Kaleidescape to continue to make DVD servers while it fought to extend the stay.
Two weeks ago, California’s 6th Appellate District upheld the stay, meaning Kaleidescape is free to sell its DVD servers until the case is settled once and for all. Happy news for Kaleidescape and dealers on the eve of CEDIA Expo 2012.
Kaleidescape believes its current appeal could take a year to play out.

Kaleidescape, Inc., H038037, is granted as follows: Let the writ of supersedeas issue, staying, pending this appeal, enforcement of the superior court’s March 8, 2012 permanent injunction order.
