Kaleidescape CEO Responds to RealDVD Ruling

Real Networks finally caved to the studios in the case against its RealDVD copying software. The company agreed to scrap plans for an appeal and pay the studios $4.5 million as reimbursement for legal fees. Real Networks (RNWK) caved to the studios yesterday. Instead of appealing a decision that deemed its $30 RealDVD ripping software illegal, the company is paying the studios $4.5 million as reimbursement for legal fees. Under the auspices of the Motion Picture Association of America (MPAA), the studios sued Real in September 2008, claiming violations under the Digital Millennium Copyright Act (DMCA). Court to RealNetworks: MPAA is not a ‘Price-Fixing Cartel’

RealNetworks, whose RealDVD ripping software has so far been deemed illegal, recently lost an antitrust claim against the studios. In May 2009, RealNetworks filed a claim against the Motion Pictures Association of America (MPAA), the organization that initially sued to keep RealDVD off the market. Real argued that the MPAA, which represents Hollywood studios, illegally conspired with the studios to craft the Content Scramble System (CSS) licensing agreement – an agreement that prohibits the sale of products that facilitate fair-use copying of encrypted DVDs. RealNetworks to Appeal Ruling on RealDVD Injunction

RealNetworks cannot sell its $30 RealDVD ripping software until the legality of the software is determined by the courts. That was the ruling made by U.S. District Court Judge Marilyn Patel in August, when she upheld an earlier court's preliminary injunction against sales of RealDVD. Now Real is appealing that decision, according to CNET. Real is being sued by the DVD Copy Control Association (DVD CCA), for breach of contract.
