The hubbub over the EPA's lead paint mitigation law seems to never die down. The latest twist is a bill introduced in the U.S. Senate yesterday by Oklahoma Sen. James Inhofe that would allow integrators and other home remodeling contractors to ask clients to forgo following the disposal procedures in the law. The bill specifically allows only homeowners with no children under 6 years old or without pregnant women to bypass the rule. There was a similar provision in the original EPA's Lead Renovation, Repair and Painting rule that would… View this story

Remodelers, installers and any other professional that touches a home built before 1978 can breathe a sigh of relief. The EPA says it will not impose a new lead-dust sampling requirement -- the so-called clearance requirements -- as part of the Lead Renovation, Repair and Painting (LRRP) rules issued last year. The agency issued this statement: The Agency believes that the existing lead-safe work practices and clean up requirements -- which went into place in 2010 -- will protect people from lead dust hazards created during renovations jobs without the… View this story

The National Association of Home Builders (NAHB) and three other associations have filed suit against the EPA over the removal of an opt-out provision in the original lead paint abatement removal law. According to the NAHB, the Hearth, Patio and Barbecue Association, the Window and Door Manufacturers Association, and the National Lumber and Building Material Dealers Association, EPA had originally included a clause that would allow homeowners without children under 6 years old or households without pregnant women to "opt out" of the rules for the handling and removal of… View this story

If you think the Environmental Protection Agency (EPA) has forgotten about its federal lead paint abatement law passed in 2010, think again. Permanent Siding and Windows, a Milford, Conn.-based contractor specializing in spray-in vinyl siding and window and door replacement, recently agreed to pay a fine of $30,702 to settle claims by the EPA that it violated the lead paint abatement law, according to the EPA. The real kicker is that Permanent Siding and Windows did not violate the law in terms of its disposal of the lead paint in… View this story

The Environmental Protection Agency (EPA) began enforcing its Lead Renovation, Repair and Painting Rule on October, 1, 2010. The EPA announced earlier this year that it would delay enforcement to allow adequate time for dealers to become trained and certified in the new regulations. While the EPA was not enforcing the regulations, they officially went into effect on April 22, 2010. All integrators working in pre-1978 homes are affected by these regulations and must be compliant. Failure to comply not only places companies at risk of significant fines from the… View this story

A coalition of housing industry groups joined the National Association of Home Builders (NAHB) in announcing plans to file a lawsuit against the federal Environmental Protection Agency (EPA) for removing the "opt-out" provision from its Lead: Renovation, Repair and Painting rule. The Lead: Renovation, Repair and Painting rule (LRRP) applies to homes constructed before 1978 when lead paint was banned. Its opt-out provision, which expired July 6, let consumers allow contractors to bypass extra preparation, clean-up and record-keeping requirements in homes where there were no children under 6 or pregnant… View this story

The Environmental Protection Agency (EPA) has agreed to extend the deadline for its new lead paint certification. CE pros must enroll in training by Sept. 30, 2010 and complete training by Dec. 31, 2010. (Read EPA press release) The EPA has also agreed to "provide additional trainers in areas of need." The EPA says most states do not have "enough certified trainers to educate contractors about these new requirements. For example, there is just one trainer in Oklahoma and three in the entire state of Maine, as well as three… View this story

At a time when there aren’t even enough instructors to train the tens of thousands of contractors that need lead-paint training, the EPA has decided to make its rules even stricter. The Lead: Renovation, Repair and Painting rule applies to homes built before 1978. Originally, the onerous lead regulations included an opt-out provision that largely limited the regulation’s applicability to older homes that were the residences of pregnant women or children under six years old. The National Association of Home Builders (NAHB) reports that the agency now is eliminating the… View this story

CE pros not already certified as lead renovators under the EPA’s Lead Renovation, Repair and Painting Program Rule, which goes into effect April 22, are probably getting nervous. Those not in compliance face $37,500 per day penalties, according to CEDIA. Companies affected include:Those working in residences built before 1978Those working in buildings occupied by pregnant women or children under six built before 1978Those renovating, repairing or painting in areas more than six square feet in an interior room or 20 square feet on an exterior wallThose replacing windows and/or doorsTo… View this story

Donning hazmat suits (from left), Joe Tooley, Brantley Waites and Jim DeWitt took the EPA lead paint certification course at EHX Spring. Dealers attending the CEDIA-sponsored Environmental Protection Agency (EPA) lead paint removal training at EHX Spring see it as a major differentiator for their businesses and a big-time detriment for companies that do not obtain the certification. It's not just a matter of the non-certified companies being susceptible to a $37,500 fine per company per day for working on a pre-1978 home, it's the potential that future clients will… View this story
